What is Sedition? The Webster's Ninth New Collegiate Dictionary says; incitement of resistance to or insurrection against lawful authority. Seditious; disposed to arouse or take part in or guilty of sedition.

The Sedition Act of 1918 is as follows: (partial)

SECTION 3. Whoever, when the United States is at war, shall willfully make or convey false reports or false statements with intent to interfere with the operation or success of the military or naval forces of the United States, or to promote the success of its enemies, or shall willfully make or convey false reports, or false statements,...or incite insubordination, disloyalty, mutiny, or refusal of duty, in the military or naval forces of the United States, or shall willfully obstruct...the recruiting or enlistment service of the United States, or...shall willfully utter, print, write, or publish any disloyal, profane, scurrilous, or abusive language about the form of government of the United States, or the Constitution of the United States, or the military or naval forces of the United States...or shall willfully display the flag of any foreign enemy, or shall willfully...urge, incite, or advocate any curtailment of production...or advocate, teach, defend, or suggest the doing of any of the acts or things in this section enumerated and whoever shall by word or act support or favor the cause of any country with which the United States is at war or by word or act oppose the cause of the United States therein, shall be punished by a fine of not more than $10,000 or imprisonment for not more than twenty years, or both...[...]

Unfortunately, it was repealed in 1921. This is why the Sedition Act is not enforced. But, let not your hearts be troubled. Just because the Sedition Act was repealed in 1921, doesn't get the cowards in DC a Get Out Of Jail Free Card. {side bar...good read here} (Smith Act)

(a) Whoever, when the United States is at war, willfully makes or conveys false reports or false statements with intent to interfere with the operation or success of the military or naval forces of the United States or to promote the success of its enemies; or Whoever, when the United States is at war, willfully causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty, in the military or naval forces of the United States, or willfully obstructs the recruiting or enlistment service of the United States, to the injury of the service or the United States, or attempts to do so - Shall be fined under this title or imprisoned not more than twenty years, or both.

(b) If two or more persons conspire to violate subsection (a) of this section and one or more such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be punished as provided in said subsection (a).

(c) Whoever harbors or conceals any person who he knows, or has reasonable grounds to believe or suspect, has committed, or is about to commit, an offense under this section, shall be fined under this title or imprisoned not more than ten years, or both.

Did Nancy Pelosi Violate the Logan Act?

Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or of any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both.

This section shall not abridge the right of a citizen to apply himself, or his agent, to any foreign government, or the agents thereof, for redress of any injury which he may have sustained from such government or any of its agents or subjects.

That is the complete text of the Logan Act, passed by the U.S. Congress on January 30, 1799, and in force to this day.

Did Speaker of the House Nancy Pelosi (and others) violate that act during a much-publicized, self-authorized trip to Syria?

The answer, like the law itself, is simple and straightforward: Yes.

Nancy Pelosi qualifies as “any citizen of the United States,” with no exemption as Speaker of the House.

Nancy Pelosi acted “without authority of the United States,” which, in matters of foreign policy, resides solely and exclusively in the executive branch of the U.S. Government, meaning the President of the United States and his designees. The President of the United States specifically disapproved of the Pelosi trip to Syria, asked her not to go and criticized her thereafter.

Nancy Pelosi directly commenced “correspondence or intercourse” with officers and agents of a foreign government.

Nancy Pelosi, by her own statements, intended and attempted to influence the “measures or conduct” of that foreign government. Those measures and that conduct directly relate to disputes or controversies with the United States (and its allies).

That the measures and conduct of Syria are among the worst of nations is of considerable concern from the standpoint of U.S. foreign policy, but is irrelevant from the standpoint of the Logan Act, which does not grade the behavior of countries or delineate among them for the purposes of its strictures.

That Speaker Pelosi says she said nothing on her trip that differs from the positions of the President is also irrelevant, from the standpoint of the law, and either woefully ignorant or ignorant and spiteful, from the standpoint of international relations.

The current policy of the U.S., as made by the executive branch, is to isolate Syria. That may be right; it may be wrong; it may not even matter. It is not, however, anywhere within Speaker Pelosi’s prerogative to tangibly interfere or even interpose herself by meeting directly with Syrian President Bashar al-Assad for the purposes of any “diplomacy.”

Pelosi’s defenders make much of the fact that she is Speaker of the House of Representatives and only behind the Vice President in order of succession to the Presidency. That may get heads nodding on television talk shows, but falls with a thud against the words of the U.S. Supreme Court, recognizing the “exclusive power of the President as the sole organ of the federal government in the field of international relations” or “the decision of the executive is conclusive.”

(Contrary to the mistaken assertions of some, presidential succession is not specified in the Constitution, but in statutory law made by Congress, subject to change, as it has changed in the past. No Speaker has ever succeeded to the Presidency. Even if one ever does, that will never make the legislative branch the executive branch or allow anyone in the legislative branch to adventure past the separation of powers that is one of the cornerstones of our government.)

It is far more pertinent to ask another question regarding Pelosi’s role as Speaker of the House. What does it say to this country that she openly violates a law made by the very legislative body of which she is the putative leader? If she disagrees with the law, for any reason, it is her job to try to change it, not to violate it, no matter how much she may disagree with the foreign policy positions of a duly-elected President.

The Logan Act may be old and no one ever before prosecuted for violating it. But it is neither ill-founded nor archaic, particularly in a time of world unrest and significant domestic tension regarding U.S. policy toward that unrest. The law does not preclude all legislators’ discussions with foreign leaders, such as fact-finding, but only those which have the unauthorized intent to influence those leaders.

As recently as September 2006, the Committee on Standards of Official Conduct of the House issued a memo to all members and officers that cautioned against activities that implicate the Logan Act, albeit intended as a warning to outgoing members. Similarly, in February 2006, the Congressional Research Service prepared a survey of the Logan Act for Congress. While neither document is particularly respectful of the law, there should at least be no one in Congress claiming not to understand it (including Speaker Pelosi’s Republican fellow travelers).

There is no question that many Americans and many in Congress disagree strenuously with foreign policy positions of the Bush Administration. Any and all, including Speaker Pelosi, may say so, loudly and often, in Congress, in the public square. But none of us, including Speaker Pelosi, has the right to conduct any foreign policy, without specific authorization of the President.

Now, Speaker Pelosi and Congressman Tom Lantos, Chairman of the House Foreign Affairs Committee, are openly discussing a diplomatic trip to “dialogue” with Iran. In the Byzantine world of foreign relations, that’s like trying to dismantle a nuke wearing only a head scarf for protection.

The Washington Post called Speaker Pelosi’s mission to Syria “foolish.” Vice President Cheney called it “bad behavior.” We call it felony

The House of Representatives is expressly authorized within the United States Constitution (Article I, Section 5, clause 2) to discipline or “punish” its own Members. This authority of the institution of the House to discipline a Member for “disorderly Behaviour” is in addition to any criminal or civil liability that a Member of the House may incur for particular misconduct, and is a device or procedure designed not so much as merely a punishment of the individual Member, but rather ultimately as a measure to protect the institutional integrity of the House of Representatives, its proceedings and its reputation.

Congressional discipline of a Member by the House of Representatives is done by the House itself, without the necessity of Senate concurrence, and may take several forms. The most common forms of discipline in the House are now “expulsion,” “censure,” or “reprimand,” although the House may also discipline its Members in others ways, including fine or monetary restitution, loss of seniority, and suspension or loss of certain privileges. In addition to such sanctions imposed by the full House of Representatives, the standing committee in the House dealing with ethics and official conduct matters, the House Committee on Standards of Official Conduct, is authorized by House Rules to issue a formal Committee reproach in the form of a “Letter of Reproval” for misconduct which does not rise to the level of consideration or sanction by the entire House of Representatives. Additionally, such Committee has also expressed its disapproval of conduct in informal letters and communications to Members.

The House may generally discipline its Members for violations of statutory law, including crimes; for violations of internal congressional rules; or for any conduct which the House of Representatives finds has reflected discredit upon the institution. Thus, each House of Congress has disciplined its own Members for conduct which has not necessarily violated any specific rule or law, but which was found to breach its privileges, demonstrate contempt for the institution, or which was found to discredit the House or Senate. When the most severe sanction of expulsion has been employed in the House, however, the conduct has historically involved either disloyalty to the United States Government, or the violation of a criminal law involving the abuse of one’s official position, such as bribery.

Nancy Pelosi is to world diplomacy what Michael Jordan was to baseball: completely forgettable and unnecessary. But unlike Michael’s slightly amusing foray into the Babe’s world, there’s nothing funny about Pelosi in Damascus. The terrorists and their supporters, who are always looking for weak links and signs that the US does not have the will or backbone to win the war we’re fighting with them, just found a great ally in Madame Speaker. Among the older members of my extended Syrian family, there was a general attitude that kindness equaled weakness. It wasn’t that they didn’t believe in charity, but that it must be parceled out carefully, because those of ill intent can be quick to take advantage of those they perceive to be gullible and soft. This is what Nancy Pelosi either doesn’t understand, or doesn’t care about: she’s being used by the very people who want to destroy us in another round of window dressing, subterfuge, and deceit. I suspect that Pelosi knows this, but is more intent on trying to undermine the President than in looking at how she could best support national security. Let’s look at the record.

Syria has admitted that it has financially supported Hezbollah and Hamas, but says that it doesn’t supply them with arms. What’s the difference? What do you think these groups buy with the money? How many Israeli and Lebanese men, women and children have been slaughtered because of Syrian backing of these groups? And who do you think Syria supports across the border in Iraq: our troops or the terrorists some blithely refer to as “insurgents”? Without the direct involvement of Syria and Iran, the current terrorism movement in Iraq would have considerably less groundswell. Pelosi might respond that she’s aware of all that, but that she’s simply taking James Baker’s advice to talk with your enemies. Well, here’s the problem: Baker’s wrong. Talking to the Syrians has never accomplished anything. They correctly read the signs a long time ago that there would be no real consequences for continuing to support Arab and Islamic terrorist groups. And Pelosi has proven them right again: bend us and we will break. This needs to stop. Syria and Iran need to know in a very real way that if they continue to support terrorism, they will experience the full wrath of the United States. And there cannot be any negotiating when it comes to this. Moammar Gadhafi —remember that boogeyman?—backed off when we bombed his palace in Libya. Gadhafi’s two-year-old adopted daughter died in that raid, which was a terrible tragedy, particularly since he was the one with blood on his hands, not her. Still, Gadhafi crawled back into his hole, and retreated even further when we invaded Iraq, making a public show of acquiescence to the US. He may be crazy, but he’s not stupid. Syria and Iran need to be given fair warning to cease and desist all support of terrorist activities, prove they’re doing so, and if they don’t, be held to account. Damascus and Tehran will continue to taunt and undermine us, and the UK, until they know they can’t. Assad would be a lot less likely to cut checks for terrorists if he knew it could cost him his job or his life. And the same is true of the little guy in the leisure suit over in Iran. This is what they both understand and respect: force, not treaties and tea. And Pelosi would probably be adverse to hang out with these guys if she knew F-18s might be approaching. Charging her with treason in the meantime would be appropriate. If the Speaker of the House during the Vietnam War had broken bread with Cambodian leaders, the public would have demanded his resignation and the most severe punishment possible for such a crime. And yet when Nancy Pelosi sits down with our enemies’ collaborators, she’s given a pass, even praised by those who cheer on any action that goes against the President. Al Jazerra is probably her biggest fan right now, next to the New York Times. The problem is she’s not just hurting the President, she’s betraying our troops, and everyone around the world at risk to terrorist attacks, which is most of us.

We should not let her get away with it. We need to hold Pelosi responsible for her actions, as well as Syria and Iran. The three of them have more than proven their status as enemies of the United States.

They have appeased themselves into a lose-lose situation at home and I for one am thrilled they have made such an enormous mess in such a short period of time.

The military thinks Nancy is a phoney who can’t be trusted, “Code Pink” (et. al) thinks she is a phoney who can’t be trusted, any Republican with a brain knows she’s a phoney who can’t be trusted…let’s see that leaves the uninformed Dems who’d vote for anybody that is Dem (like the special interest groups etc.) and they’ll only vote if someone tells them to, like a union boss or a minister (or a $20 bill handed directly to the voter will do just fine too I guess).

What he learned was that the Democrats are all show and no go. We’ll pretend we support the troops by passing a bill that has no chance of the President signing, and then we can say we tried but that President just pulled the support right out from under you. As stated earlier, the troops know what is going on. And by the way, they vote too!And you guys just keep on making people angry who might not normally vote, and the results will be like last Satu rday’s rally in DC: Good Guys 30,000 — Traitors 5,000.

That’s how the Associated Press described yesterday’s vote by the House to demand a U.S. retreat from Iraq, and in the perverse calculus of Capitol Hill we suppose it was. Speaker Nancy Pelosi has demonstrated she can pile on enough pork to bribe enough Democrats to cobble together a bare, partisan majority to “send a message” that has no chance of becoming law. Congratulations.

“Today is an historic day,” Ms. Pelosi said on the House floor. “The new Congress will vote to end the war in Iraq.” But of course the bill does nothing of the sort. If she truly wanted to end the war, the Speaker and her fellow Democrats could simply have used their power of the purse to refuse to fund it. But that would have meant taking some responsibility for what happens in Iraq, which is the last thing Democrats want to do. So they have passed a bill that funds the war while claiming it ends the war.

The bill’s “benchmarks” and deadlines certainly have nothing to do with achieving victory in Iraq, or assisting General David Petraeus’s campaign to secure Baghdad. They are all about the war inside the Democratic Caucus. On the one hand, they appease the antiwar left by pretending to declare the war illegal if certain goals aren’t met by Iraqis or U.S. forces. But on the other, they allow “moderates” from swing districts to claim they are nonetheless “supporting the troops.” Acts of Congress don’t get much more cynical than that.

This is not to say the vote won’t do considerable harm. It will be noted by our enemies in Iraq and will encourage them to inflict more casualties to further sour American support. It will make it harder for Iraq Prime Minister Nouri al-Maliki to disarm Shiite militias, who can point to the vote and say the Americans will soon be leaving. And most disgraceful, it will send a message to U.S. troops that they can fight on — albeit without much chance of success and without Congressional support.

The lengths that Democratic leaders had to go to win their “triumph” betrayed its cynicism. To get her narrow majority of 218 votes, Ms. Pelosi and Appropriations Chairman David Obey had to load it up like a farm bill: $74 million for peanut storage, $25 million for spinach growers, $283 million for dairy farmers — all told, some $20 billion in vote-buying earmarks of the kind Democrats campaigned against last year.

Even at that price, they could win over a mere two Republicans: antiwar Members Wayne Gilchrest of Maryland and Walter Jones of North Carolina. We hope GOP primary voters note those votes well. Given how the war hurt so many Republicans last November, this GOP solidarity is notable and a credit to the minority leadership.

President Bush was quick to denounce the vote yesterday, promising a veto. And we hope he keeps it up. By bowing to their antiwar left, Democrats are once again showing that they can’t be trusted on national security. The President should drive that message home until Congress gives him a clean war bill that gives our troops the money to fight our enemies without having to take orders from MoveOn.org.
